Terms of Service

for artwork commissions

By requesting a commission and by making a payment for the commission, you automatically agree to the following terms of service:

Artwork(s) may be commissioned by private individuals, groups, and companies for non-commercial projects. Up-to-date price lists are available on my DeviantArt and Tumblr accounts. It is possible to purchase the right to use the commissioned artwork(s) in a commercial manner for an additional fee.

GENERAL INFORMATION

  • For personal use only (non-commercial)
  • Digital goods only (no shipment required)

PAYMENT

  • I accept USD or GEL (Georgian Lari)
  • Full pre-payment or 50% pre-payment, depending on commission type (see respective price lists)
  • Partial refund possible on certain commissions (see respective price lists) if the finished sketch is rejected and any further work is cancelled.

THE COMMISSIONER’S RIGHTS

  • All rights on the depicted characters, locations or items belong to their rightful owner. The commissioner remains the sole owner of their original characters, settings and creations that are depicted on the commissioned artwork.
  • All personal, non-commercial usage is allowed.
  • Printing the commissioned artwork(s) onto a physical object (poster, mug, etc) is allowed as long as it’s done for personal, non-commercial purposes.
  • Turning the commissioned artwork(s) into an NFT is strictly prohibited.*
  • The commissioner is allowed to repost the commissioned artwork(s) online. Credit is not required but endorsed. Claiming to be the artist/author is prohibited.
  • Editing and making alterations (cropping, repainting etc) of the commissioned artwork(s) is allowed provided the changes have been clearly stated in a suitable manner.
  • Animating a piece is allowed.

THE AUTHOR’S RIGHTS

  • The author owns the copyright on every commissioned artwork they create.
  • The author reserves the right to post (or not) the commissioned artwork(s) and WIPs on their social media websites (Tumblr, X, ArtStation, etc but also Patreon, Fiverr etc), giving suitable credit to the commissioner.
  • The author reserves the right to post timelapses and recorded streams of a commissioned artwork on their video-compatible social media websites (Youtube, Twitch, Rumble etc), giving suitable credits to the commissioner.
  • The author reserves the right to stream the creation process live on their social media websites (Youtube, Twitch, Rumble etc) WITHOUT suitable credits at that time, unless the commissioner requests the author not to do so.
  • The author reserves the right to use the commissioned artwork(s) for self-promotion.
  • The author reserves the right to refuse a commission request without explanation.
  • The author does not provide to the commissioner (or anyone else) the original file (.psd, .krita and others)
  • The author does not commit to a deadline. If one is required, on the authors discretion, it can be purchased for an additional fee.

GENERAL RULES

  • References and text descriptions are always required unless the author states otherwise in private communication with the commissioner.
  • There is no exact limit on alterations possible during the creation process. However, large alterations must be requested early, while small alterations are still possible at later stages. Exceeding a reasonable amount of alterations or major alterations at later stages are subject to an additional fee (see respective price lists).
  • The commission request is rejected automatically if it contains any of the following themes or subjects: gore, explicit sexual content, real-world political or military content from WWII – present day
  • If the commissioner is underage, it is automatically assumed that they have parental concern.
  • The commissioner must be a legal adult to request artistic nudity and pinup content.
  • The commissioner receives a high-resolution file of the commissioned artwork(s) as soon as full payment has been completed.
  • Business is done in good faith.

ADDITIONAL FEES

  • To use the commissioned artwork(s) in a commercial manner, an additional fee of +100% of the total commisison price is required, as well as giving credit in a suitable manner.
  • To complete the commissioned artwork by a certain dealine after the full payment has been received, a fee of up to +200% of the total comission price is required.

*The author reserves the right to inform the general public of the commissioner monetizing the copyrighted artwork(s) and will ban the commissioner from commissioning the artist ever again.
